Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of all services provided by mxNAP (“Company,” “we,” “us,” or “our”). By using our web hosting, VPS, dedicated servers, colocation, public cloud, or any other IT infrastructure services, you agree to comply with this AUP.

The purpose of this AUP is to ensure the security, reliability, and integrity of our network and the internet community at large.

1. Lawful Use of Services

All services provided by mxNAP may be used for lawful purposes only. The Customer agrees to comply with all applicable local, state, federal, and international laws. Transmission, storage, or presentation of any information, data, or material in violation of any law is strictly prohibited.

2. Prohibited Content

Customers may not host, upload, or distribute content that includes, but is not limited to:

  • Illegal Material: Any content or materials that are unlawful under applicable law, regulation, or statute.
  • Copyright Infringement / Piracy: Unauthorized distribution, reproduction, or making available of copyrighted works (including software, audio, video, or other media) or facilitating infringement.
  • Infringing Material: Material that infringes on intellectual property rights, including patents, trademarks, and trade secrets.
  • Harmful Content: Child sexual abuse material, hate speech, material that promotes violence, or content that is defamatory or libelous.
  • Malicious Code: Distribution of viruses, worms, Trojan horses, or any other destructive software.
3. Prohibited Activities

The following activities are strictly prohibited on mxNAP infrastructure:

  • Spam / Unsolicited Bulk Email: Strictly no unsolicited bulk email (SPAM), unsolicited commercial email, or any activity that results in mxNAP IP addresses or domains being listed on blocklists.
  • Open Relays / Mail Abuse: Running open mail relays, open proxies, or misconfigured mail services that allow third parties to send email without authorization is prohibited.
  • Hacking/Cracking: Unauthorized access to or use of data, systems, or networks, including any attempt to probe, scan, or test the vulnerability of a system.
  • Port Scanning: Any port scanning, network scanning, or similar reconnaissance activity (whether directed at mxNAP systems or third-party systems) without explicit written authorization.
  • Denial of Service (DoS/DDoS): Engaging in activities that interfere with the service of any user, host, or network, including but not limited to network flooding and deliberate attempts to overload a system, including distributed denial of service (DDoS) activity.
  • IP Spoofing: Forging any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
  • Phishing: Engaging in activities designed to collect personal information under false pretenses.
4. System and Network Security

Violations of system or network security are prohibited and may result in criminal and civil liability. mxNAP will investigate incidents involving such violations and will involve law enforcement if a criminal violation is suspected. Security violations include:

  • Unauthorized monitoring of data or traffic.
  • Interfering with service to any user, host, or network.
  • Circumventing user authentication or security of any host, network, or account.
5. Resource Usage

To ensure the stability of our Smart Hosting environment, customers using shared hosting, VPS, or public cloud resources must not consume excessive system resources (CPU, Memory, Disk I/O, or network bandwidth) that negatively impact other users or the stability of the platform.

  • Resource Abuse: Scripts, processes, containers, or workloads that overload shared or VPS servers are prohibited. This includes, without limitation, cryptocurrency mining, intensive background processes, automated scraping that creates excessive load, or any activity that causes sustained high CPU usage, excessive I/O, or abnormal network usage.
    mxNAP reserves the right to suspend any account that uses resources to the point where it degrades the performance of the server or network.
6. Specific Service Provisions
  • VPS and Dedicated Servers: Customers are responsible for the security of their own instances. While mxNAP provides the infrastructure, the software and data management reside with the Customer.
  • Colocation: Equipment placed in mxNAP facilities must comply with electrical and safety standards. Any equipment causing interference with the network or other customers must be removed immediately.
  • IP Address Allocation and Use: Any IP addresses provided by mxNAP must be used in accordance with applicable registry policies and requirements (including RIPE NCC and/or ARIN rules, as applicable), including accurate and complete registration details and proper justification/assignment. Customers must not sub-allocate, reassign, or use IP space in a way that violates registry policies or mxNAP instructions.
  • VPN and Licenses: Use of cPanel, Plesk, Enhance, or other licenses provided by mxNAP must strictly adhere to the respective vendor’s End User License Agreement (EULA).
7. Enforcement

mxNAP reserves the right to monitor its systems to ensure compliance with this AUP. We reserve the right to remove any material or terminate any service that violates this policy.

  • Immediate Suspension for Violations: Any violation of this AUP may result in immediate suspension (without notice) to prevent further violations, protect our network, or protect other customers.
  • Termination: Repeated or flagrant violations will lead to immediate termination of the Customer’s account without a refund.
  • Cooperation with Law Enforcement: mxNAP will cooperate fully with law enforcement agencies in investigating suspected lawbreaking.
8. Reporting Abuse

Any party wishing to report a violation of this AUP may contact the mxNAP Abuse Department at abuse@mxnap.com.

9. Amendments

mxNAP reserves the right to modify this AUP at any time. Notice of changes will be posted on mxnap.com. Continued use of the services after such changes constitutes acceptance of the new terms.
